Press Council decides on 55 complaints

The Press Council of Kosovo (PCK) in its regular meeting reviewed a total of 55 complaints. The members of the PCK Assembly decided to approve seven of them, partially approve two, reject five and declare 41 complaints inadmissible.

The complaints concerned allegations of violations of certain chapters of the Kosovo Press Code, namely Chapter II – Reporting the Truth, Chapter III – Incitement and Hate Speech, Chapter IV – Right to Reply, Chapter V – Persons involved in incidents, accidents, arrested or charged with criminal offenses and Chapter VII – Privacy and Protection of Sources.

The Press Council of Kosovo has approved the complaint by S. B., represented by lawyer Amer Alija, against Kojshiashow.com regarding the article titled “Esat Shala in tears: Reveals the well-known politician who brought S. B. – the perpetrator of massacres – to Kosovo! The host is shocked!”, finding a violation of Chapter II of the Kosovo Press Code, which concerns truthful reporting.

The Press Council of Kosovo has approved the complaint by N. K. against Nacionale.com regarding the article titled “What Kurti promised regarding the PAK and how Milot Kelmendi’s sister – a member of the WhatsApp group with Nagip Krasniqi – came to lead it,” finding a violation of Chapter II of the Kosovo Press Code, which concerns truthful reporting.

The Press Council of Kosovo has approved the complaint by B. T. against Sinjali.com regarding the article titled “Diart Bytyqi detained in connection with the shooting in Prizren, a name known to law enforcement,” finding a violation of Chapter VII of the Kosovo Press Code, which concerns the protection of privacy.

The Press Council of Kosovo has approved the complaint by A. T. L. against Sinjali.com regarding the article titled “’Exclusive | Traffic ticket escalates into a clash with police in Kaçanik – one suspect allegedly punched an officer, the other threatened: ‘I’ll kill you’”, finding that Chapter VII of the Kosovo Press Code, which concerns the protection of privacy, was violated.

The Press Council of Kosovo has approved the complaint by E.D. against Asistionline.com regarding articles titled “FBK’s 3×3: Many tournaments and many words, but Kosovo is just there to participate”, “Walking around in Taranto!”, “FBK Secretary in Taranto: Is Kosovar basketball heading for collapse?”, ” Walking around in Taranto = A Farce,” and “Attempting to shift the debate does not make the questions disappear: facts and documents speak for themselves,” finding that Chapters II and IV of the Kosovo Press Code, concerning truthful reporting and the right of reply, respectively, were violated.

The Press Council of Kosovo has approved the complaint by the Cabinet of the Acting President of the Republic of Kosovo against Ekonomiaonline.com regarding the article titled “Haxhiu on announced protests: if they are about the Specialist Chambers, the opposition should apologize,” finding that Chapter II of the Kosovo Press Code, concerning truthful reporting, was violated.

The Press Council of Kosovo has approved the complaint by E.A. against Sinjali.com regarding the article titled “Exclusive | Secretary of the ‘Drenica’ Hunting Association stabbed in the chest and leg in Skenderaj – two suspects flee,” finding that Chapters V and VII of the Kosovo Press Code, concerning the presumption of innocence and the protection of privacy, respectively, were violated.

The Press Council of Kosovo has partially approved the complaint by Barileva Turist L.L.C. against Indeksonline.net, Insajderi.org, Gazetakosova.com, Frontonline.net, Veriu.info and Zyrtare.net regarding articles titled “The 63,000 euros undeclared at Customs – here is the company that was transporting them”, “Reportedly, Barileva Turist was transporting the 63,000 euros undeclared at Customs” and “…Barileva Turist was transporting them, they were found in the driver’s personal luggage”. The Council found a violation of Chapter IV of the Kosovo Press Code, which concerns the right of reply, but not of Chapter II, which concerns truthful reporting, as claimed by the complainant.

The Press Council of Kosovo has partially approved the complaint by Z. S. against Voxkosova.com regarding a video titled “Document – RTK removes the criterion that candidates must not be under investigation, solely to make room for Vetëvendosje party loyalists in leadership positions”. The Council found a violation of Chapter IV of the Kosovo Press Code, which concerns the right of reply, but not of Chapter II, which concerns truthful reporting, as claimed by the complainant.

The Press Council of Kosovo has rejected the complaint by G.M. against Rahovecpost.com regarding the article titled “Ambulance delayed by 30 minutes,” finding that Chapter II of the Kosovo Press Code, which concerns truthful reporting, was not violated, contrary to the complainant’s claims.

The Press Council of Kosovo has rejected the complaint by R.G. against Veriu.info regarding the video titled “RTK engages in propaganda regarding the Iber Bridge, KFOR remains there, yet even the police have not been deployed after 27 years,” finding that Chapter II of the Kosovo Press Code, which concerns truthful reporting, was not violated, contrary to the complainant’s claims.

The Press Council of Kosovo has rejected the complaint by the Office of the Acting President of the Republic of Kosovo against Klankosova.tv regarding the article titled “Opposition says ‘no’ to Haxhiu. Kurti and ministers head to the Presidency,” finding that Chapter II of the Kosovo Press Code, which concerns truthful reporting, was not violated, contrary to the complainant’s claims.

The Press Council of Kosovo has rejected the complaint by N.H. against Insajderi.org regarding the article titled “’Despicable judges, you are causing harm to citizens’: Albulena Haxhiu’s former lawyer lashes out at the Court of Appeals and Valon Totaj,” finding that Chapters II and IV of the Kosovo Press Code, which concern reporting the truth and the right of reply, respectively, were not violated, contrary to the complainant’s claims.

The Press Council of Kosovo has rejected the complaint by R.A. against Sinjali.com regarding the article titled “Exclusive: This is the police officer whose sons were allegedly attacked by Besart Ahmeti in front of his wife and two children – he, too, was interviewed as a suspect,” finding that Chapter II of the Kosovo Press Code, which concerns reporting the truth, was not violated, contrary to the complainant’s claims.

The Press Council of Kosovo has declared inadmissible the complaints of J. U. against 36 media for the removal from the web pages of articles published four years ago, finding that the complaining party should address the case to each media separately or in a civil dispute.

The Press Council of Kosovo has declared inadmissible F. D.’s complaint against Betimiperdrejtesi.com as it does not have the authority to handle the content broadcast on video platforms that are not part of media self-regulation.

The Press Council of Kosovo has declared inadmissible K.T.’s complaint against several media, since the complaining party has not provided the complete case for treatment.

The Press Council of Kosovo has declared inadmissible G. R.’s complaint against JOQ Kosovo, for a picture published on this page on the social network Facebook, since it does not have the competence to handle the content produced by pages or profiles on social networks.

The Press Council of Kosovo has declared inadmissible B. Xh.’s complaint against Berat Buzhala for an article published on his profile on the Facebook social network, since does not have the authority to handle complaints against individuals.

The Press Council of Kosovo has declared inadmissible the complaint of F. S. and A. S. against Tv Klan Kosova, since it does not have the competence to handle the contents broadcast on video platforms that are not part of the self-regulation of the media or on television. The complaining party can turn to the Independent Media Commission (IMC).
