The Press Council of Kosovo (PCK) in its regular meeting reviewed a total of 18 complaints. The members of the PCK Assembly decided to approve two of them, partially approve one, reject nine and declare five complaints inadmissible. Meanwhile, one complaint was found to have been resolved through mediation between the parties.
The complaints concerned allegations of violations of certain chapters of the Kosovo Press Code, namely Chapter II – Reporting the Truth, Chapter III – Incitement and Hate Speech, Chapter IV – Right to Reply, Chapter V – Persons Involved in Incidents, Accidents, Arrested or Accused of Criminal Offenses, Chapter VII – Privacy and Protection of Sources and Chapter XI – Copyright.
The Press Council of Kosovo has approved the complaint of Adrijana Hoxhiq, represented by lawyer Arbër Shala, against Ditori.com, for the article titled “Adrijana Hoxhiq pressured Albanian workers to leave their jobs, who are on a 6-month probationary period in north Mitrovica”, finding that Chapter II of the Kosovo Press Code, which deals with reporting the truth, was violated.
The Press Council of Kosovo has approved Elbunit Kryeziu’s complaint against Rahoveci24.com for the article titled “The work of President Smajl Latifi, as always, does not stop, forcing the Prolab doctor and the director of the QKMF, Elbunit Kryeziu to activate the laboratory at the QKMF”, finding that Chapter II of the Kosovo Press Code, which deals with reporting the truth, has been violated.
The Press Council of Kosovo has partially approved the complaint of the Ministry of Education, Science, Technology and Innovation (MESTI) against Insajderi.org for the article titled “Major crime scheme with tenders, how the Ministry of Education group in the Kurti II Government functioned that damaged the budget by nearly 6 million euros”, finding that Chapter V of the Kosovo Press Code, which deals with the presumption of innocence, was violated, but not Chapter II, which deals with reporting the truth, as the complainant claims.
The Press Council of Kosovo rejected the complaint of Green Med L.L.C., represented by attorney Blinera Osmani, for the article titled “‘Customs Intelligence launches investigations into ‘Green Med’: Mother is a health inspector, son is a business with medicinal products’”, concluding that Chapter II of the Kosovo Press Code, which deals with reporting the truth, was not violated, as claimed by the complainant.
The Press Council of Kosovo rejected the complaint of Avni M. Leci against Gazetaeksluzive.com for the article titled “Besnik Berisha, the president of the KBA threatens lawyer Leci: If you do not pay the annual fee, you will lose the right to practice law!”, finding that Chapter II of the Kosovo Press Code, which deals with reporting the truth, or Chapter IV, which deals with the right to reply, were not violated, as claimed by the complainant.
The Press Council of Kosovo rejected the complaint of the KAF Institute against Kallxo.com for the article titled “The National Audit Office pays for training for staff at the Institute where the Deputy Auditor General is a lecturer”, finding that Chapter II of the Kosovo Press Code, which deals with reporting the truth, was not violated, as claimed by the complainant.
The Press Council of Kosovo rejected the complaint of Post and Telecom of Kosovo against Indeksonline.net, Infosot.com, Periskopi.com and Demantim.com for the articles with the titles “Kosovo Telecom distributes millions with single-source contracts for foreign companies”, “Without competition and no competition: Kosovo Telecom gives 72 thousand euros to a company from Skopje”, “100 thousand euros single-source tender from Kosovo Telecom, a company from the USA is awarded”, finding that chapters II and IV of the Kosovo Press Code, which deal with reporting the truth, respectively the right to reply, have not been violated, as claimed by the complaining party.
The Press Council of Kosovo rejected the complaint of Ilirjana Çollaku – Tafë against Insajderi.org for the article entitled “The Fall of Sami Mazreku – How it was defended with silence by the SPRK and how it was sunk by an internal audit”, finding that chapters II and IV of the Kosovo Press Code, which deal with reporting the truth, respectively the right to reply, were not violated, as claimed by the complainant.
The Press Council of Kosovo rejected the complaint of Nexhmedin V. Gruda against Ekonomiaonline.com for the article titled “Residents of Lower Zabel complain about lack of intervention after floods, municipality says damages are being assessed”, finding that Chapter II of the Kosovo Press Code, which deals with reporting the truth, was not violated, as claimed by the complainant.
The Press Council of Kosovo rejected the complaint of the American Clinic “Dr. Behar Kusari”, represented by lawyer Albulena Ukimeraj, for the article titled “‘M.V.: I lost my testicle after the doctor’s mistakes at the American Clinic’ – the inspectorate issues a ridiculous fine for the illegal work of Dr. Ekrem Sefiu”, finding that Chapter II of the Kosovo Press Code, which deals with reporting the truth, was not violated, as claimed by the complainant.
The Press Council of Kosovo rejected the complaint of Union L.L.C. against Insajderi.org for the article titled “Businessman Xhabir Kajtazi’s firm seized once again by the AUV – worrying suspicions of toxins in baby milk”, finding that chapters II, IV, V and VII of the Kosovo Press Code, which deal with reporting the truth, respectively the right to reply, respectively the presumption of innocence, respectively privacy, have not been violated, as claimed by the complaining party.
The Press Council of Kosovo rejected the complaint of Bejtullah Deliu, represented by lawyer Fatbardh Makolli, against Kallxo.com, for the article entitled “Confession of the investor who denounced the bargains in the Municipality of Rahovec”, finding that Chapter II of the Kosovo Written Media Code, which deals with reporting the truth, was not violated, as claimed by the complaining party.
The Press Council of Kosovo has declared inadmissible the complaint of Construmax L.L.C., represented by lawyer Valdrin Behrami, against Prishtina Sot, a Facebook social network page, since it does not have the competence to handle media content published on social networks.
The Press Council of Kosovo has declared inadmissible the complaint of Ensar Shaqiri against Radio Dukagjini, since it does not have the competence to handle media content published on social networks.
The Press Council of Kosovo has declared the complaint of the Islamic Community – The mosque of Wil, represented by lawyer Asdren Bytyqi, against Klankosova.tv and Tv Klan Kosova inadmissible. The complaining party has not provided evidence for the content published in the online media, consequently the PCK has been unable to decide. As for the content broadcast on television, the PCK recommends that the party address the Independent Media Commission (IMC).
The Press Council of Kosovo has declared the complaint of Merrushe Ahmeti against Gazeta Albapoli, a page on the social network Instagram, inadmissible, since it does not have the competence to handle media content published on social networks.
